Replace "email address" with "picture" or "likeness" and you start to see the magnitude of the challenge.
If you have a digital camera and you take a picture of your friend, who owns the picture? Who has license to "use" it? Friends can work that out implicitly (sometimes explicitly, depends how good of friends you are), but what if in the picture there was a friend of my friend who is not my friend? How transitive are these "implicit licensing terms" between friends?
It's a good thing facebook went back to the old TOU; they would have had mass defections (and still could).
